1. Who we are
Bula Work is a platform operated by BULA WORK LLC, a limited liability company formed in the State of Florida, United States. We operate exclusively within the United States. You can reach us at info@bulawork.us.
2. What Bula Work is and is not
Bula Work is a marketplace connecting four types of user: Homeowners, Companies and contractors, Subcontractors and Skilled workers. The platform lets users post jobs, express interest, agree on terms, hold payment in escrow and release it by milestones or approved hours.
Except for the hourly staffing case described in section 5, Bula Work is NOT a party to the work agreement between users, is not a general contractor, does not direct or supervise how the work is performed, and does not guarantee the quality, timeliness or outcome of any job. That relationship is between the parties who agree to it.
3. Who may use the platform
- You must be at least 18 years old.
- You must be legally authorized to work, or to hire work, in the United States, as applicable to your role.
- Your account information must be true and current. An account is personal and non-transferable.
- If you offer a trade that requires a state or local license, you are responsible for holding it and keeping it current. Bula Work may ask you for proof.
4. Fees
Posting a job is free and unlimited. We charge no membership, no subscription and no pay-per-lead. Current fees are:
Payment processing is performed by Stripe and is subject to its own terms. We may change these fees going forward; changes will be announced in the app at least 30 days in advance and will not apply to jobs already closed.
5. The two work models: 1099 and W-2
Subcontractors (1099)
Subcontractors are independent businesses. They are not employees of Bula Work nor of whoever hires them through the platform. They are responsible for their own taxes, licenses, insurance, tools and personnel. Where applicable, the corresponding 1099 form will be issued.
Hourly staffing (W-2)
In the hourly staffing service, BULA WORK LLC acts as the worker's employer of record: it assumes W-2 payroll, tax withholding and applicable employment obligations. The company requesting personnel sees a single all-inclusive hourly rate. That rate covers the worker's pay and the platform's 40% margin.
6. Escrow and milestones
- When an agreement closes, the agreed amount is held in escrow before work begins.
- Funds are released by milestone, when the hiring party approves the corresponding stage; or by approved hours, in the case of hourly work.
- How soon released funds land in the recipient's bank account depends on Stripe and on their bank.
- Withholding approval of a stage that was actually delivered, in order to avoid paying, is a violation of these Terms.
7. Time tracking and location
For hourly work, clock-in and clock-out are recorded with location verification (GPS) and a photo taken at that moment. This data is used to verify hours worked and resolve disputes about them. A worker's location is not tracked outside the recorded shift. How this data is handled is described in our Privacy Policy.
8. Prohibited conduct
- Posting false information about your identity, experience, licenses or portfolio.
- Exchanging phone numbers, emails or addresses inside the chat before an agreement is closed. Chat opens only when an offer has been accepted, and terms belong inside the offer.
- Deliberately taking a job that originated on the platform off-platform in order to avoid the fee. Beyond violating these Terms, doing so forfeits escrow, milestones and platform support.
- Harassment, threats, discrimination or any abusive treatment of another user or of our team.
- Falsifying time records, location or clock-in and clock-out photos.
- Using the platform for illegal activity, or for work requiring a license you do not hold.
9. Content you post
Photos, videos and text in your portfolio remain yours. By posting them you grant us a non-exclusive license to display them within the platform in order to operate the service. You must have the rights to what you post and must not expose third parties' private information. Homeowners carry no public portfolio, to protect their privacy.
10. Verification and ratings
Verification badges indicate that we reviewed certain information, such as identity or a license. They are not a guarantee of work quality nor an endorsement of the person. Ratings and reviews come from other users and reflect their opinion, not ours. We may remove a review that is false, abusive or unrelated to the work performed.
11. Disputes between users
If a disagreement arises over a job, either party may open a dispute inside the app. While a dispute is open, the associated escrowed funds are frozen. Our team will review the evidence available on the platform (milestones, progress photos, time records and messages) and may release, hold or return the funds. This review is a platform service, not a legal arbitration, and does not prevent the parties from pursuing whatever legal remedies are available to them.
12. Insurance
Each user is responsible for carrying the insurance their activity requires by law. In Florida, construction requires workers' compensation from the first employee. In the hourly staffing service, coverage for the W-2 worker is maintained by BULA WORK LLC as employer of record.
13. Suspension and account closure
We may suspend or close an account that breaches these Terms, puts other users at risk or makes fraudulent use of payments. Where reasonable, we will give notice first. You may close your account at any time from the app or by writing to us. Closing an account does not cancel payment obligations already incurred nor jobs in progress.
14. The service is provided as is
We take reasonable steps to keep the platform running continuously and securely, but the service is provided “as is”. We do not guarantee uninterrupted availability, complete absence of errors, or that you will find work or personnel within any particular timeframe.
15. Limitation of liability
To the maximum extent permitted by applicable law, BULA WORK LLC's total liability to any user, for any claim arising from use of the platform, will not exceed the greater of: (a) the total fees that user paid us in the six months preceding the event, or (b) one hundred US dollars (US$100). We are not liable for indirect damages, lost profits or lost business opportunity. Nothing in this section limits liabilities that cannot be limited by law.
16. Changes to these Terms
We may update these Terms. When a change is material, we will give notice inside the app at least 30 days in advance and update the effective date at the top of this page. Continuing to use the service after that date means you accept the new version.
17. Governing law
These Terms are governed by the laws of the State of Florida, United States, without giving effect to its conflict-of-law rules. Any dispute will be submitted to the competent courts located in Florida.
